DATA PROCESSING NOTICE

This is the Data Processing Notice (also known as a Privacy Policy) of Liberate.  It is issued in compliance with the Data Protection (Bailiwick of Guernsey) Law, 2017 “the Law”

We are committed to protecting and respecting your personal data and ensuring you are informed about how we use it.  We acknowledge our obligations under the Law, and we undertake to the best of our ability, to protect your personal data in accordance with the Law.

We acknowledge that all processing of personal data must be lawful, fair and undertaken with transparency.

This Notice sets out how and why we collect and use your personal data and our legal basis for doing so.

Who are we?

We are Liberate. We are Guernsey charity and registered with the Guernsey Registry (no. CH468).  We are also registered with The Office of the Data Protection Authority (registration number DPA2453).

What do we do?

Liberate was established in 2014 to promote fairness and equality. Liberate also provides support for the Lesbian, Gay, Bisexual, Transgender, Queer and Questioning (LGBTQ+) community, together with their friends and families within the Bailiwick of Guernsey (Guernsey, Alderney, Sark and Herm). 

We campaign for positive change in laws and opinions with the aim to promote acceptance of everyone identifying as LGBTQ+. We aim to do this with the input and support of the LGBTQ+ community.

We want to stand as positive role models and provide a voice for the Bailiwick’s LGBTQ+ community.

We wish to put in place support services for LGBTQ+ people growing up and growing old within the Bailiwick of Guernsey.

We wish to create an island community where everyone stands in equal footing with their neighbour regardless of their ability, age, beliefs, gender identity, race, religion, sex or sexuality.

What data we collect

We only hold limited details of relating to our service users and partners.  This not only enables us to contact our service users and partners to enable us to carry out our core business services and/or comply with a contract, but also to comply with statutory requirements and our legal obligations.

Where does this data come from?

The personal data we process is given to us directly by you, our service users and partners, from someone else acting on your behalf (e.g. parent or guardian) and/or from inquiries through our website, telephone calls, emails or social media.  We do not collect any personal data from any other sources.

How we use your personal data

We use the personal data you provide to deliver our services, respond to enquiries, and keep you informed about relevant updates or events. Your information is only used for the purposes you consent to and is never shared without your permission, except where legally required.

Our lawful basis for processing your personal data

In order to be able to provide you with the services you require, we use our legal contractual basis for processing your personal data and/or rely on our legitimate business interests.

Consent

In instances where we are not relying on a contractual and/or legitimate business interests’ basis, we rely on consent to lawfully process your personal data.  This can be obtained orally, by email or letter, through online forms, via surveys or feedback, by message within our groups chats, automatically through online interactions such as social media interactions, website cookies and analytical tools, or by publicly available sources. You have the right to withdraw your consent at any time, however, it must be highlighted that by withdrawing your consent we may not be able to provide you with our core business services.

Types of personal data we collect

  • Your contact details, such as: name, postal address, email address and contact number
  • A record of our communications with you
  • Your lifestyle details – via surveys
  • Your health details – via service user or counselling consent forms

Special category data

Defined in the Law as – “Personal data revealing an individual’s racial or ethnic origin, political opinion, religious or philosophical belief, trade union membership, genetic data, biometric data, health data, data concerning an individual’s sex life or orientation, & criminal data.”  The Law requires this data to be processed with additional protection.

As part of our work, we may collect special category data (for example, relating to health, sexual orientation, or gender identity) where it is necessary to provide support services or to ensure that our activities are inclusive and accessible.  We only process this data with your explicit consent, which may be obtained through a signed document, consent form, or clear written agreement. Such information is handled in strict confidence and in accordance with the Law.

Sharing of your personal data

We do not share your personal data with any third party without your knowledge and consent. In certain cases, and only with your explicit consent, we may share relevant information with trusted counsellors or support professionals in order to provide you with the services you have requested. All such sharing is strictly limited to what is necessary and is carried out in line with the Law.

Transfer of data

We do not transfer your personal data outside the Bailiwick of Guernsey.

Direct marketing

We may use your personal data to send you information about our events, campaigns, or services, but only where you have given us your explicit consent to do so. You can withdraw this consent or opt out of receiving marketing communications at any time by using the unsubscribe link in our emails or by contacting us directly.

Retention of data

All data is retained securely and only used for the purposes for which it was collected under the Law.  Data is only retained for as long as is required to comply with our statutory obligations, in order for us to provide you with the services forming part a contract or with your consent.  In any event, data is reviewed and weeded accordingly after 7 years. Your rights

The Law provides you with a number of rights, but specifically and of relevance, you have the right to:

  • request confirmation of the personal data that we hold about you and what we are doing with your data
  • request correction of your personal data if incorrect, out of date or incomplete
  • request that we stop any consent-based processing of your personal data after you have withdrawn that consent

Social media

This notice does not cover any third-party websites or social media sites used in conjunction with Liberate.We are not responsible for the actions or activities of third-party website/social media outlets.  You are advised to read the data collection and privacy statements on other websites and social media outlets you visit.

Cookies

Cookies (often known as internet cookies) are text files with small pieces of data — like a username and password — that are used to identify your computer as you use a network. Specific cookies are used to identify specific users and improve your web browsing experience.  You may manage your cookies by adjusting your browser settings to accept, refuse, or delete cookies. Most browsers allow you to see what cookies are stored and to clear them at any time. Please note that disabling cookies may affect how our website functions and could limit your ability to use certain features.

Contacting the regulator

If you feel that your personal data has been handled incorrectly or you are unhappy with our response to any requests you have made to us regarding the use of your personal data, you have the right to lodge a complaint with the data protection regulator – The Office of the Data Protection Authority (ODPA).  You can contact them for advice by writing to:
